Electronic Recyclers International (ERI) has filed a lawsuit against IT asset disposition (ITAD) company Revivn Public Benefit Corporation, alleging that the firm engaged in a coordinated effort to recruit its employees and use confidential operational information to compete in the electronics recycling sector.
Revivn is an ITAD company focused on enterprise technology reuse and refurbishment. ERI is one of the largest electronics recyclers in the United States and operates multiple processing facilities across North America.
The complaint was filed in March in the Commercial Division of the New York County Supreme Court under case number 651256/2026. Electronic Recyclers International, Electronic Recyclers of America and Electronic Recyclers International NYC are listed as plaintiffs. Revivn Public Benefit Corporation is named as the defendant.
According to the filing, ERI alleges that Revivn carried out what the complaint describes as a deliberate campaign to recruit senior employees from the company while seeking access to proprietary operational processes and strategic information developed over years of operating large-scale electronics recycling facilities.
The lawsuit claims that Revivn hired former ERI executives and employees with knowledge of internal systems and business methods. ERI states in the complaint that its business relies on internal processes, logistics planning and operational frameworks that it considers trade secrets. The company alleges that Revivn targeted those employees and then used that information to advance its own operations.ERI contends that the hiring activity violated contractual obligations and confidentiality restrictions that applied to certain employees.
The filing also alleges that Revivn has expanded its presence in California and is preparing to establish operations in Fresno, the city where ERI maintains a major facility and corporate headquarters. ERI asserts that the proposed location would position Revivn to recruit additional employees from its workforce.
Attorneys for ERI argue that the alleged conduct threatens the company’s competitive position in the ITAD and electronics recycling sector. The complaint seeks relief that could include restrictions on the use of confidential information and limitations on further recruitment of ERI employees.
The plaintiffs are represented by attorneys Erik S. Groothuis, Jeffrey M. Eilender and John David Moore of Schlam Stone & Dolan LLP. The case has been assigned to Justice Robert R. Reed in the New York County Supreme Court Commercial Division. Court records show that Revivn had not yet filed an answer or formally appeared on the docket at the time the filings were submitted.
E-Scrap News contacted both companies seeking comment. A representative for ERI said the company could not comment due to pending litigation and Revivn did not respond to requests for comment by the time of publication.
